
LICENSE AGREEMENT
OF IMAGE USE
This contract is valid from August 2021.
This site is owned and operated by Artes Melina SS LTDA. These Terms set out the terms and conditions under which you can use our website and services offered by us. This website offers visitors digital photographic backgrounds. By accessing or using our service website, you signify that you have read, understood and agree to be bound by these Terms.
Please review these Terms of Service when purchasing any Content license.
Artes Melina reserves the right to change these Terms of Service at any time and at its own discretion. Prior to the entry into force of any changes, Artes Melina will use reasonable efforts to notify you. Such notification may occur by e-mail registered in your Artes Melina account, by an advertisement on this page, by the login page and/or by other means. Changes to these Terms of Service will only apply to future purchases (including any automatic renewals). By licensing Content following such changes, you agree to the modified version of the Terms of Service.
THIS IS A SINGLE LICENSE THAT AUTHORIZES AN INDIVIDUAL TO LICENSE, DOWNLOAD AND USE CONTENT. NO OTHER PERSONS (INCLUDING EMPLOYEES, CO-WORKERS OR SUPPLIERS) MAY ACCESS YOUR ACCOUNT OR USE LICENSED CONTENT USING YOUR ACCOUNT.
For clarification purposes, if you are acting as an employee, your employer will be deemed the licensee for the purposes of the license.
"Content" consists of all content available for licensing on the Artes Melina website,
"Image(s)" consist(s) of still photographs, vectors, drawings, graphics and the like.
VISUAL CONTENT LICENSES
Through this instrument, Artes Melina grants you a non-exclusive, non-transferable, global and perpetual right to use and reproduce Visual Content, as expressly permitted by the applicable license and subject to the limitations set forth herein. An IMAGE LICENSE grants you the right to use Images:
Such as digital reproduction, including on websites, online advertising, social media, mobile advertising, mobile applications, software, electronic cards (“e-cards”), electronic publications (e-books, electronic magazines, blogs, etc.), advertising by email and online media (including on video sharing services such as YouTube, Dailymotion, Vimeo, etc.) subject to the budgetary limitations set forth in subsection I.4 below);
On printed material in physical form as part of a product's packaging and labeling, letterhead and business cards, point-of-sale advertising, CD and DVD cover art, or on tangible media advertising or copying, including magazines, newspapers and books, as long as no Image is reproduced more than 500,000 times in total;
As part of an out-of-home media advertising campaign, including billboards, street furniture, etc., as long as this campaign's aggregate target audience reach is less than 500,000 gross impressions.
In a film, video, television series, advertising or other audiovisual production for distribution in any currently known or future developed medium, without regard to audience size, provided the budget for such production does not exceed $10,000;
For personal non-commercial use (resale, download, distribution or any other type of commercial use is prohibited)
RESTRICTIONS ON USE OF VISUAL CONTENT
IT'S FORBIDDEN:
Use the Visual Content other than as expressly determined by the license you purchased with respect to the Visual Content.
Use any Visual Content in a pornographic, defamatory or misleading context, or in a manner that could be considered libelous, obscene or illegal.
Resell, redistribute, provide access, share or transfer any Visual Content. The foregoing provisions entail the prohibition, for example, of making the Content available in the form of a content “gallery” (or as part of one), in which third parties can perform searches and selections from it.
Use Visual Content in such a way as to infringe any trademarks or intellectual property of a third party, or to give rise to legal action for misleading advertising or unfair competition.
Use any Visual Content (whether in whole or in part) as a trademark, service mark, logo or other indication of origin, or as part of one.
Falsely state, explicitly or reasonably implicitly, that Visual Content was created by you or someone other than the copyright owner(s) of such Visual Content.
